The China National Intellectual Property Administration (CNIPA) recently issued Decision No. 5880655, declaring invalid in its entirety Chinese Utility Model Patent No. 202122937813.1, titled “Airflow Guiding and Smoothing Device for Pulmonary Function Testing” (the “Patent at Issue”), owned by a Chongqing-based technology company. This decision fully supported the invalidation request filed by our client.

The Patent at Issue had previously been challenged twice by other parties in separate invalidation proceedings, and had been partially upheld on those occasions. This time, however, the invalidation was successful in full, owing to the robust evidence of prior art identified by Tangsong IP Firm, including two German patent documents, one Japanese patent document, and one European patent document.
